Understanding disability rights helps individuals and families access appropriate services, opportunities, and support systems.
Takshashila promotes a rights-based, person-centered, and inclusion-focused approach while recognizing that legal eligibility and government procedures are determined by competent authorities.
1. The Rights of Persons with Disabilities (RPwD) Act, 2016 is the principal legislation protecting and promoting the rights of persons with disabilities in India.
Provides a legal framework relating to disability rights, including:
How to use it:
Families and professionals can access the Act, Rules and assessment guidelines through the official DEPwD website and refer to the provisions relevant to their circumstances.
2. National Trust Act, 1999
The National Trust Act, 1999 provides a legal and welfare framework for persons with:
The National Trust works through mechanisms that support legal guardianship, welfare, caregiving, empowerment, awareness and capacity building.
How to access services:
The National Trust's legal functions include providing legal guardianship through Local Level Committees, while its welfare functions are delivered through various schemes and programmes.
3. Rehabilitation Council of India Act, 1992
The Rehabilitation Council of India (RCI) regulates education and professional standards in the rehabilitation and special-education sector.
RCI maintains the Central Rehabilitation Register (CRR) for recognised rehabilitation professionals and personnel.
For applicable regulated rehabilitation services, families should ensure that professionals possess the appropriate recognised qualification and valid RCI registration.
How to verify a professional:
RCI states that persons with recognised rehabilitation qualifications must be enrolled on the Central Rehabilitation Register to practise as regulated rehabilitation professionals/personnel.
Unique Disability ID – UDID
The Unique Disability ID (UDID) project provides a national system for disability certificates and Unique Disability ID cards.
The UDID system is designed to facilitate access to government benefits and services for eligible persons with disabilities.
Application Process:
Step 1 – Submit Application
Register and submit the application through the official UDID portal.
Step 2 – Select Medical Authority
Select the appropriate hospital/medical authority for disability assessment.
Step 3 – Application Verification
The concerned authority verifies the application and may request corrections or additional information.
Step 4 – Specialist Assessment
The applicant attends the scheduled assessment by the relevant specialist doctor(s).
Step 5 – Medical Board Review
The Medical Board reviews the assessment and determines the applicable disability type and percentage according to the prescribed guidelines.
Step 6 – Certificate & UDID Card
After approval, the disability certificate and UDID card are generated through the system.
Assessment of Specified Disabilities
Disability certification is based on the prescribed government assessment guidelines and assessment by the competent medical authority.
A diagnosis alone does not automatically determine the percentage of disability. The authorised medical authority follows the applicable assessment methodology.
General Process:
Assessment → Medical Authority → Medical Board → Disability Certificate → UDID
Families should always refer to the latest government-notified guidelines because assessment procedures and requirements may be revised.
Government Schemes & Support (open in accordian)
Schemes for Persons with Disabilities
Government schemes may provide support in areas such as:
How to Find the Right Scheme
Eligibility and benefits vary between schemes and may change through government notifications.
Legal Guardianship & Welfare Support
Eligible persons covered under the National Trust framework may access services relating to legal guardianship and welfare programmes.
General Process:
Identify Need → Check Eligibility → Approach Local Level Committee → Submit Application → Verification → Decision/Service
Families should obtain information directly from the competent authority because guardianship involves legal responsibilities and the applicable procedure depends on the individual circumstances.
Choosing Qualified Rehabilitation Professionals
Families seeking rehabilitation and special-education services should consider:
RCI's current guidance identifies categories including clinical psychologists, rehabilitation psychologists, special teachers, audiologists and speech therapists, vocational rehabilitation professionals and other rehabilitation personnel.
